Welcome to TextPolish! These Terms of Service ("Terms") govern your access to and use of the TextPolish API service ("Service") operated by TextPolish Technologies ("we," "our," or "us").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

1. Acceptance of Terms

By creating an account, accessing our API, or using any part of our Service, you:

TextPolish provides an API-based service for grammar, style, and readability analysis. Our Service analyzes text submissions and returns detailed reports including grammar issues, readability scores, sentiment analysis, and writing quality metrics.

3. Account Registration and API Keys

3.1 Account Creation

To use our Service, you must:

Provide accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Be responsible for all activity under your account

3.2 API Keys

Important: Upon registration, you will receive an API key. You must:

Keep your API key confidential
Never expose your API key in client-side code or public repositories
Use your API key only for your own applications
Not share your API key with third parties

We are not responsible for unauthorized use of your API key if you fail to keep it secure.

4.2 Free Trial

New users receive a 7-day free trial with full access to their selected plan. No credit card is required to start the trial. After the trial period:

Your subscription automatically begins if payment information is provided
You will be charged the monthly fee for your selected plan
You can cancel anytime during the trial without charge

4.3 Billing

By subscribing to a paid plan, you agree to:

Pay the monthly subscription fee for your selected plan
Provide valid payment information through Stripe, our payment processor
Automatic monthly billing on the anniversary of your subscription start date
Payment in US Dollars (USD)

All fees are non-refundable except as required by law or as explicitly stated in these Terms.

5. Cancellation and Refunds

5.1 Cancellation

You may cancel your subscription at any time:

Cancellations can be made through your account dashboard
You will retain access until the end of your current billing period
Your API key remains active until the subscription expires
No refunds are provided for partial billing periods

5.2 Refund Policy

We generally do not offer refunds for subscription fees due to the nature of our API service. However, we may issue refunds at our sole discretion in cases of:

Technical issues preventing you from using the Service
Billing errors or unauthorized charges
Other exceptional circumstances

To request a refund, contact support@textpolish.io within 14 days of the charge.

6. Acceptable Use Policy

You agree to use our Service only for lawful purposes and in accordance with these Terms.

6.1 Prohibited Uses

You may not use our Service to:

Violate any laws or regulations
Infringe on intellectual property rights
Transmit malware, viruses, or harmful code
Attempt to gain unauthorized access to our systems
Reverse engineer, decompile, or disassemble our API

7. Intellectual Property Rights

The textPolish Service, including the API, website, documentation, code, algorithms, and trademarks, is owned by TextPolish Technologies and protected by intellectual property laws.

7.2 Your Content

You retain all rights to the content you submit to our API. By using our Service, you grant us a limited license to process your content to provide the Service.

Important: We do not store your content or use it for any purpose beyond the immediate API response. Once your request is processed, your content is permanently deleted.

8. Warranties and Disclaimers

Service "As Is"

OUR SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. While we strive for high accuracy, we do not guarantee:

That our Service will identify all grammar, style, or readability issues
That all suggestions will be applicable to your specific context or writing style
Any specific improvement in writing quality or readability scores

You acknowledge that automated grammar and style analysis provides suggestions based on general writing standards, and final editorial decisions remain your responsibility.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEXTPOLISH SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or use
Business interruption

Our total liability to you for all claims shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

10. Changes to Terms

We may modify these Terms at any time by:

Posting updated Terms on our website
Sending email notification to registered users
Updating the "Last Updated" date

Your continued use of the Service after changes constitutes acceptance of the modified Terms.
